Great article. I look forward to becoming a member. Just for clarification, the "Act" only states that a registered "primary caregiver" (as defined within the act) in compliance with the "Act," "may assist no more than 5 qualifying patients with their medical use of marihuana" (Sec 6(a).)

The only logical/common sense way that a "registered primary caregiver" could provide for 6 patients (as mentioned in the article) is if the "primary caregiver" is also providing marihuana to themselves as qualified patient (the 6th person). However, the courts in their infinite wisdom, sometimes check logic at the doors to the courthouse.

If a primary caregiver was not a patient, in no way could they provide for 6 qualified patients.

I would like to know if anyone has contacted the owner of Gone Wired, with any formal request to hold a meeting at her place of business?

After the actions of a few at the last meeting, I will be sure to ask her if such communication has occurred in earnest.

If Senator Kuipers wants pharmacies to handle cannabis sales, and the IRS by law must not accept any "normal business tax deductions" from any business which engages in a Schedule I transactions, shouldn't Senator Kuipers first be focusing his attention on getting cannabis out of Schedule I at the federal level before suggesting such foolish Catch-22 legislation be imposed on state businesses ?

This is the ruling that so concerned me regarding loss of all deductions for normal business expenses when business has engaged in Schedule I trafficking ~ for IRS purposes, as you can see from the ruling [download the PDF file - its pretty clear], cannabis IS Schedule I and any kind of economic transfer for <cannabis> is going to disallow your deductions.

The answer is, of course, to follow the Michigan law and take care to never indicate and Schedule I transaction in any tax filing - you are providers of <services>, consultants or health aides or however one chooses to describe their services.

Yes, it certainly signals a Change ... but Holder's guidelines are a far cry from the Executive Order we have been promised; an EO would effect all Federal agencies, not just the Justice Department. WE have miles to go ...
